Who we are and what this policy covers
Pertinacity, LLC ("Pertinacity," "we," "us," or "our") is a Delaware limited liability company with its principal place of business at 510 Somerville Avenue, Unit 1, Somerville, MA 02143. We are a growth marketing agency serving business clients.
This Privacy Policy explains how we collect, use and disclose information in connection with pertinacity.io and the pages, forms, gated content, scheduling tools and other features we make available through it (the "Site"). It applies to visitors to the Site.
What this policy does not cover
This policy governs the Site only. It does not govern personal information we process on behalf of a client during a services engagement. Where we handle data within a client's systems or on a client's instruction, we act as a service provider or processor, and that processing is governed by the services agreement, statement of work and any data processing terms between us and that client, not by this policy.
This policy also does not cover the practices of third-party websites or services we do not control, including those we link to.
Information you provide to us
We collect information you choose to give us. This typically includes:
- your name, business email address, company name, role and any message or details you include when you submit a form on the Site, including our contact form;
- the information you provide when you register for or request gated content such as a guide, report, template or webinar, which is generally the fields shown on that form;
- information you provide when you book a meeting through our scheduling tool, including your name, email address and any context you add to the booking;
- information contained in email or other correspondence you send us;
- any other information you volunteer.
You are not required to provide any of this to browse the Site. If you choose not to provide it, we may be unable to respond to an inquiry, deliver requested content or schedule a conversation.
Gated content and registration
Some materials on the Site are available only after you complete a registration form. When you register, we use the information you provide to deliver the material you asked for, to understand which topics are useful, and to follow up with related information about our services where permitted by law. You may opt out of those follow-up communications at any time. Registering for gated content does not create a client relationship.
Information collected automatically
When you visit the Site, certain information is collected automatically by us and by the service providers whose technology we use. This may include your IP address, approximate location derived from it, browser and device type, operating system, referring page, the pages and content you view, links you click, the dates and times of your visits, and similar technical and usage information.
Cookies and similar technologies
We and our service providers use cookies, pixels, tags and similar technologies on the Site, in the following general categories:
- Strictly necessary. Technologies required for the Site to function, to maintain security and to process form submissions.
- Analytics and performance. Technologies that help us understand how the Site is used in aggregate, such as which pages are visited and how visitors arrive.
- Advertising and social. Technologies provided by advertising platforms and professional networks that help us measure the performance of our campaigns and reach relevant business audiences.
The specific technologies we use change over time as we add, replace or remove tools, and not every category described above is necessarily active at any given moment. Some of these technologies are operated by third parties who may collect information about your activity across different websites over time.
Most browsers let you refuse or delete cookies through their settings. Blocking some categories may affect how parts of the Site function. Where required by applicable law, we obtain consent before setting non-essential cookies.
How we use information
We use the information described above to operate and secure the Site; to respond to inquiries and schedule conversations; to deliver gated content you request; to provide, evaluate and improve our services; to send business communications and marketing you have requested or that are permitted by law; to understand and improve how the Site performs; to measure our marketing; and to comply with legal obligations and enforce our terms.
Legal bases (visitors in the EEA and UK)
Where the GDPR or UK GDPR applies, we process personal information on the basis of your consent (for example, non-essential cookies and marketing email); our legitimate interests in operating, securing, measuring and promoting our business, where those interests are not overridden by your rights; the necessity of processing to take steps at your request before entering into a contract; and compliance with legal obligations.
How we share information
We do not sell personal information. We share it only as follows:
- Service providers. With vendors who provide services to us, including website hosting, customer relationship management, scheduling, email delivery, analytics and advertising measurement, and only as needed for them to perform those services.
- Professional advisors. With our accountants, lawyers, insurers and similar advisors where reasonably necessary.
- Legal and safety. Where we believe in good faith that disclosure is required by law, regulation, legal process or governmental request, or is necessary to protect our rights, safety or property or those of others.
- Business transfers. In connection with a merger, acquisition, financing, reorganization or sale of all or part of our business, subject to customary confidentiality protections.
- At your direction. With your direction or consent.
Marketing communications
If you receive marketing email from us, you may opt out at any time using the unsubscribe link in the message or by contacting us at info@pertinacity.io. We may still send you communications relating to an active inquiry or engagement.
Retention
We retain personal information for as long as needed for the purposes described in this policy, which generally means for the duration of our relationship or inquiry and for a reasonable period afterward, and thereafter as necessary to comply with legal obligations, resolve disputes and enforce our agreements. Retention periods vary by the type of information and the purpose for which it was collected.
Security
We maintain administrative, technical and physical safeguards designed to protect information against unauthorized access, use, alteration and destruction. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Your choices and rights
Depending on where you live, you may have rights to request access to the personal information we hold about you; to request correction or deletion of it; to request a portable copy; to opt out of certain processing, including targeted advertising and any sale or sharing of personal information; and to appeal a decision we make about a request. We do not discriminate against anyone for exercising these rights.
To make a request, contact us at info@pertinacity.io. We may need to verify your identity before acting, and we will respond within the time required by applicable law. An authorized agent may submit a request on your behalf where the law permits, subject to verification.
Where we process personal information on behalf of a client, requests should be directed to that client, and we will assist them as our agreement with them requires.
Global Privacy Control and Do Not Track
Where required by applicable law, we treat a Global Privacy Control or similar browser-level opt-out signal as a valid request to opt out of the sale or sharing of personal information for that browser. Browsers also offer a "Do Not Track" setting; because there is no common industry standard for responding to it, we do not currently respond to Do Not Track signals.
Please do not send us protected health information
The Site is a general business website. It is not a portal for patient data, and it is not intended to receive protected health information as defined under HIPAA or comparable law. Please do not submit protected health information, patient records or similar sensitive data through our forms, gated content registrations, scheduler or email. Where we handle such information for a client, we do so under a separate written agreement and through channels agreed with that client, never through the Site.
International visitors
We operate in the United States and information we collect is processed and stored in the United States and in other countries where our service providers operate. Privacy laws in those countries may differ from those in your jurisdiction. By using the Site you understand that your information may be transferred to and processed in those locations.
Children
The Site is directed to businesses and business professionals. It is not directed to children under 16, and we do not knowingly collect personal information from them. If you believe a child has provided us information, contact us at info@pertinacity.io and we will delete it.
Third-party sites and content
The Site links to third-party websites, platforms and content we do not control. This policy does not apply to them, and we are not responsible for their content or privacy practices. Review the privacy policy of any site you visit.
Changes to this policy
We may update this policy from time to time. When we do, we will revise the effective date above, and we will provide additional notice where required by law. Your continued use of the Site after an update takes effect constitutes acceptance of the revised policy.
